The Evolution of Notarization
Did you know that the history of notarization dates back over 2,000 years to ancient Rome? And here I thought I was an ‘experienced’ notary with just over two decades of service! Notaries back then were known as scribae, who served as public officials documenting legal agreements and contracts. Virtual online notarization has revolutionized the traditional notarization process by allowing documents to be notarized electronically via secure audio-visual technology, eliminating the need for signers and notaries to be physically present in the same location. This advancement has significantly streamlined various legal and financial transactions, offering enhanced convenience and efficiency. On the other hand, in my opinion, in-person notarization will always be essential for the older generation who may not be as comfortable with technology, as well as those who simply prefer the traditional method of notarization.
The RON Movement
The virtual notarization journey began in 2011 when Virginia became the first state to enact legislation authorizing notaries to perform online notarizations remotely using audio-visual communication tools. This pioneering move set the stage for other states to explore and adopt similar measures. Over time, other states followed suit such as Montana, Nevada and Texas. Then, the pandemic in 2020, acted as a catalyst accelerating the rise for RON across the United States. However, in California and other states where RON was not yet implemented, notaries during that time continued to follow in-person notarization guidelines, including conducting signings outdoors, maintaining a minimum six-foot distance, wearing N95 masks adhering to all necessary safety precautions. Remote online notarization became a solution in many business sectors, including real estate, legal, and financial services. As a result, many states expedited the enactment of RON legislation to facilitate notary needs during the pandemic.
RON Legislation Status
As of January 1, 2024, nearly 47 states have enacted some form of RON legislation reflecting a significant shift towards embracing digital solutions in notarization practices. Each state has established its own set of regulations and standards governing the practice of remote online notarization, ensuring that the integrity and security of the notarization process are maintained in the digital realm. Some states such as California are still in development to approve online notarization and currently, have enacted Senate Bill 696 (SB 696) in hopes to approve remote online notarization by 2030. In the meantime, anyone can either access a remote online notary through an approved state or work with San Diego Notary Signing Agent to facilitate their virtual online notarization needs through vetted RON approved notary partners across the country. It’s important to note that even though a remote online notarization can be done in an approved state, the client should always check if it will be accepted from the receiving agency.
