Terms & Conditions/ Opt-In Policy

Welcome to San Diego Notary Signing Agent. Please carefully read the following terms and conditions, which govern the use of our services, including general notary work, (inclusive of estate planning signings, loan signings, witness services, and professional administrative services), virtual notarization facilitation services, apostille services and translation services. By engaging our services, you agree to comply with these terms.
 

General Terms
 

  • All Sales are Final

    • No refunds or returns will be issued for any completed service, including notarizations, apostilles, translations, virtual notarization facilitation or any other service provided by San Diego Notary Signing Agent, unless an error was made by the notary public.
       

  • Fees and Charges

    • All fees for notary service, apostilles, translations, and other services are clearly outlined on the website and transparently communicated to the client through online booking, email or text prior to the service.

    • The notary has the right to charge additional fees as permitted by California law, including travel fees based on distance and location for mobile notary services and administrative fees for complex or time-consuming requests.

    • Payment for all services is due at the time of service unless other arrangements have been made in advance. We accept cash, check, Zelle, PayPal, Venmo and major credit cards.
       

  • Cancellation Policy

    • Clients must provide at least 24 hours' notice to cancel or reschedule an appointment. Late cancellations may incur a fee.

    • For mobile services, if the notary arrives at the agreed location and the appointment cannot proceed due to client unavailability, incomplete documents and signer capacity, a trip fee will be charged.

 

  • Disclaimer

    • I am not an attorney and do not provide legal advice. I cannot explain or interpret the contents of any document for you, instructing you on how to complete a document, advise you to sign a particular document, or to making decisions regarding legal matters. Clients are encouraged to consult with a qualified attorney for legal matters.

    • Our liability is limited to the cost of the services provided. We are not responsible for damages resulting from the improper use of notarized documents.
       

  • Client Responsibility

    • The client is responsible for ensuring the accuracy, completeness, legibility and legality of all documents submitted for notarization, apostille, or translation services inclusive of verifying the spelling of names, dates, and other important information.

    • The notary role is limited to witnessing signatures, verifying identity, and administering oaths where required. We are not responsible for the content of the documents being notarized.

    • Any errors or omissions in the documents may result in delays, additional fees, or rejection by government agencies.

    • The client is responsible for understanding the requirements and regulations of the receiving agency or country regarding apostilles, translations, and other document authentication services.
       

  • Privacy and Confidentiality

    • We are committed to protecting client privacy. Any personal or document-related information shared with us will be handled in compliance with applicable privacy laws.
       

  • Shipping & Delivery

    • The client is responsible for all shipping costs, which will be calculated based on the weight and destination of the package.

    • The client is responsible for ensuring that the shipping address is accurate and complete. Any errors or omissions may result in delays or additional shipping charges.

    • We offer international shipping services through reputable carriers. However, we are not responsible for any delays, damages, or losses that may occur during shipping. The client is responsible for any custom duties, taxes, or other fees that may be imposed by the destination country.
       

 Specific Services Terms
 

  • General Notary Work

    • Identification Requirements: Clients must present valid, government-issued photo identification for all notarization services. Acceptable forms of ID include driver’s licenses, state ID’s, passports, or other identification as permitted by California law.

    • Scheduled Appointments: Appointments can be scheduled online, by phone, or via email and not necessarily required based on availability.

    • Rescheduled Appointments: The notary reserves the right to cancel or reschedule appointments due to unforeseen circumstances, including inclement weather, illness, or emergencies. The client will be notified as soon as possible in the event of a cancellation or rescheduling.

    • Refusal of Services: The notary reserves the right to refuse service at their discretion, particularly if the client or the requested notarial act appears suspicious, fraudulent, or illegal.
       

  • Apostille Services

    • Standard & Federal Apostilles

      • Clients must provide original or certified copies of documents requiring apostille certification. We will not accept altered or incomplete documents.

      • We are not responsible for delays or rejections by government agencies. However, we will make every effort to assist the client in resolving any issues that may arise.

      • If notarization is required for the documents, the client is responsible for ensuring that the documents are properly notarized before submitting them for apostille services.

      • If the documents are already notarized, the client must verify that the notarization meets the requirements of the destination country. If re-notarization is necessary, additional fees may apply.

      • Clients may choose from available delivery options, including in-person pickup, standard shipping, or expedited courier services. Additional fees may apply.

      • We will provide the client with tracking information once the documents have been submitted to the appropriate state or federal office.

      • Apostille processing times vary based on the document type and destination country. An estimated timeline will be provided during consultation but are not guaranteed. Typically, processing times for federal background check apostilles are typically longer than for standard apostilles.

    • Out-of-State & Other Apostilles

      • We can obtain apostilles for documents issued in other states. However, additional fees and processing times may apply.
        ​

    • Embassy Legalization

      • Embassy legalization is required for documents that will be used in countries that are not members of the Hague Apostille Convention.

      • The process for embassy legalization varies depending on the specific embassy or consulate. We will provide the client with detailed instructions and assistance throughout the process.

      • Additional fees may apply for document translation, authentication, and legalization services.


By submitting documents for apostille services, the client acknowledges that they have read, understood, and agreed to these terms and conditions and accept full responsibility for the accuracy, completeness, and legality of the documents and for meeting all requirements for the apostille process. Any discrepancies not due to the notary will be at the expense of the client.
 

  • Virtual Notarization Facilitation

    • Defined as: The ability for documents to be electronically signed and notarized by a preferred notary partner in an approved remote online notary (RON) state (the State of California is not currently approved to do remote online notarization). Electronic notarizations are facilitated on behalf of San Diego Notary Signing Agent to connect the signer to an approved remote online notary (RON) state. All are conducted based on the compliance of the state law and are recognized by most states and countries. However, it is the client's responsibility to verify whether the receiving agency or country will accept an electronic notarization and signature.

    • Eligibility: Remote online notarization (RON) services are available to clients with internet access and compatible devices. All signers must provide valid identification and pass an identity verification process for knowledge-based authentication (KBA) or Biometrics.

    • Technology Requirements: Clients are responsible for ensuring their devices meet the technical requirements for video conferencing and e-signature software.

    • Recordings: All RON sessions are recorded as required by law by a remote online notary in an approved state that offers RON. By using this service, you consent to the recording of the session via RON notary partners.

    • No-Show Policy: If you fail to appear for your scheduled RON appointment within the 10-minute grace period following the designated start time, and we are unable to complete the notarization due to your absence, the following refund policy will apply:

      • 50% Refund: You may receive a 50% refund of the service fee

      • 100% Credit: Alternatively, you may choose to apply 100% of the service fee as a credit towards a future (1) RON service of equal value

    • Communication Efforts: In the event of a no-show, the notary will make reasonable attempts to contact you (the signer[s])

    • Exclusions: This policy applies to no-shows only. If the RON session cannot be completed due to technical issues on the notary's end, or other circumstances beyond your control, a full refund or rescheduling will be offered.
       

 By scheduling a RON facilitation appointment, you acknowledge and agree to the terms of this disclaimer.
 

  • Estate Planning Notary Services

    • Clients must ensure all estate planning documents (e.g., wills, trusts, powers of attorney) are prepared by a qualified attorney prior to notarization.

    • I am not an attorney and do not provide legal advice. Clients are encouraged to consult with a qualified attorney for legal matters.

    • Fees are either a flat fee or based on the number of documents, travel, and any additional services requested, such as printing, courier services and/or need for a shipping label disclosed when services are scheduled.

 

  • Translation Services

    • All translations are performed by a trusted partner, Idiomatic Translations. We guarantee the accuracy and completeness of all translations.

    • A notarized Certificate of Accuracy is included with all translations.
       

Amendments

San Diego Notary Signing Agent reserves the right to update these terms and conditions at any time. Any changes will be posted on our website and will take effect immediately upon posting.

  • Your phone number

  • Any information you provide in response to SMS messages

  • Message delivery and interaction data (such as whether a message was opened or clicked)
     

How We Use Your Information: We use the information collected through SMS messages for the following purposes:

  • To send service updates, promotional offers, and important notifications

  • To respond to customer inquiries and provide support

  • To improve our messaging services and enhance user experience

  • To comply with legal and regulatory requirements
     

Sharing of Information: We do not sell, rent, or share your SMS-related information with third parties except in the following cases:

  • When required by law or legal process

  • With service providers who assist us in delivering SMS services, provided they adhere to confidentiality agreements

  • In case of a business transfer, merger, or acquisition, where your information may be transferred as part of the assets
     

Opting Out: You can opt out of receiving SMS messages from us at any time by replying "STOP" to any message you receive. Once you opt out, you will no longer receive SMS communications from us unless you re-enroll.
 

Data Security: We take reasonable measures to protect your personal information from unauthorized access, alteration, or disclosure. However, no data transmission over mobile networks can be guaranteed as 100% secure.
 

Children’s Privacy: Our SMS services are not intended for individuals under the age of 13. We do not knowingly collect information from children. If we learn that we have collected data from a minor, we will take steps to delete it.

Updates to This Policy: We may update this SMS Privacy Policy periodically. Any changes will be posted on our website with the revised effective date.
